This Disclaimer applies to carmenmair.com, and to all content we publish or share, including our programs, courses, downloads, emails, social media, podcasts, videos, webinars, live calls and community spaces. In this Disclaimer, "we", "us" and "our" mean Carmen Mair, ABN 32 044 854 723, trading as Carmen Mair and The Fertility Circle.

1. YOUR RIGHTS UNDER CONSUMER LAW

Nothing in this Disclaimer excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law, or any other law that cannot lawfully be excluded, including the consumer laws of the country you live in.

2. EDUCATIONAL INFORMATION, NOT MEDICAL ADVICE

2.1 Carmen Mair is a functional nutritionist and nutrition coach. She is not a medical doctor, and our services are not medical services.

2.2 The general content we publish, including on this website, social media, emails, podcasts and free resources, is for education and information only. It is general in nature and does not take your individual health, history or circumstances into account. It is not medical advice, and it is not a substitute for diagnosis or treatment by your doctor, fertility specialist, IVF clinic or other qualified health professional.

2.3 Please speak with your doctor or treating clinic before making changes to your diet, supplements, medications or lifestyle, particularly if you are trying to conceive, undergoing fertility treatment, pregnant, breastfeeding, or managing a diagnosed medical condition. Never stop or change prescribed medication, or delay seeking medical care, because of something you have read or heard from us.

2.4 Not for emergencies. If you experience severe pain, heavy bleeding, symptoms of ovarian hyperstimulation, signs of a possible ectopic pregnancy, or any other urgent symptom, contact your doctor or clinic immediately, or call emergency services (000 in Australia).

3. WHEN YOU BECOME A CLIENT

Reading our website or following our content does not make you a client. A client relationship begins only when you purchase a program, membership, consultation or course and accept our Terms and Conditions. Personalised guidance is provided only within those paid services, and is based on the information you give us.

4. SUPPLEMENTS

Any supplement information in our general content is educational and not a recommendation for you personally. Supplements can interact with medications, including fertility medications, and may not be suitable during pregnancy or for certain health conditions. Always check with your prescribing doctor or clinic before starting any supplement.

5. PATHOLOGY AND LAB INTERPRETATION

Where we discuss or review blood tests or other pathology, we may refer to functional or optimal ranges, which can be narrower than the reference ranges used by laboratories and medical practitioners. This interpretation is educational and nutritional in nature. It is not a medical diagnosis, and it does not replace review of your results by your doctor.

6. MIND-BODY AND NERVOUS SYSTEM PRACTICES

Our programs may include mindset, visualisation, relaxation, breathwork, guided audio and other mind-body techniques [, including techniques drawn from NLP and hypnosis]. These are offered for general wellbeing and relaxation. They are not psychological treatment or therapy, and they do not replace care from a psychologist, counsellor or mental health professional. If you have a mental health condition, a history of trauma, epilepsy or dissociation, please check with your health professional before using these practices, and stop if you feel unwell or distressed. Never listen to guided relaxation audio while driving or operating machinery. If you are struggling emotionally, please contact your GP, a mental health professional, or Lifeline on 13 11 14 in Australia.

7. NO GUARANTEED RESULTS

Every body and every fertility journey is different. We do not guarantee any particular outcome, including conception, pregnancy or a live birth. Results depend on many factors, including your health, medical history, treatment and circumstances, many of which are outside our control.

8. TESTIMONIALS AND CLIENT STORIES

Testimonials and client stories we share are genuine experiences, shared with the client's permission. They reflect individual results, which are not necessarily typical, and they are not a promise that you will achieve the same result. Where a testimonial describes a pregnancy or other outcome, other factors, including medical treatment, may also have contributed.

9. ACCURACY OF INFORMATION

We take care to make sure our content is accurate, evidence-informed and up to date. However, nutrition and fertility research changes over time, and we cannot guarantee that all general content is complete or current at all times.
